Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") are an agreement between you and WebUplink ("WebUplink", "we", "us"). By accessing or using the WebUplink API ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service
WebUplink provides a web-actions API for AI agents: point it at any URL and the page comes back as named, callable tools your agent invokes like functions. The Service includes the REST API, TypeScript SDK, MCP server, and documentation.
3. API Keys and Authentication
You are responsible for safeguarding your API keys. Do not share, embed in client-side code, or commit API keys to public repositories. You are responsible for all activity under your API key.
4. Acceptable Use
The full policy — including the verification-gated login-automation capability and our CAPTCHA and bot-detection position — is the Acceptable Use Policy, which is incorporated into these Terms by reference. In summary, you agree not to use the Service to:
- Violate any applicable law or regulation
- Access websites in violation of their terms of service or robots.txt directives
- Scrape, harvest, or collect personal data without consent
- Circumvent access controls, CAPTCHAs, or bot-detection mechanisms
- Perform credential stuffing, account takeover, or unauthorized credential use
- Engage in automated activity that degrades Service performance
- Attempt to access restricted domains, including banking, financial, streaming, or ticketing platforms
- Probe internal networks, cloud metadata endpoints, or private IP ranges
- Send spam, conduct phishing, distribute malware, or facilitate fraud
5. Credential Handling
When you pass credentials (passwords, tokens, cookies, or authentication data) as tool parameters, they exist only in the ephemeral browser session and are destroyed when the session ends. WebUplink never stores, logs, or persists credentials at rest. You must have proper authorization to use any credentials you provide. Credentials must not be shared or transferred between different WebUplink accounts.
6. Infrastructure Providers
WebUplink operates on third-party managed infrastructure, including a specialist browser-infrastructure provider. You may not use the Service in a way that violates our infrastructure providers' acceptable-use requirements; the conduct rules in our Acceptable Use Policy encompass these requirements, and we will communicate any additional provider restriction that affects your use with reasonable notice. In the event of a conflict, the more restrictive provision applies.
7. Enforcement
Violations of these Terms may result in immediate suspension of your account, rate limiting, or permanent termination at our sole discretion without prior notice. We reserve the right to investigate suspected violations and cooperate with law enforcement where required. If you believe someone is violating these Terms, contact report@webuplink.ai.
8. Rate Limits and Quotas
The Service enforces per-plan rate limits and monthly action quotas. Exceeding these limits may result in temporary throttling or suspension. Current limits are documented in the pricing documentation.
9. Data Handling
WebUplink does not store page content, credentials, or personal data from browsed websites beyond the duration of a browser session. Sessions expire after 2 minutes of inactivity or 15 minutes total. See our Privacy Policy for details.
10. Service Level and Availability
WebUplink aims for high availability but does not guarantee uptime. The Service depends on third-party infrastructure (browser, cloud, and AI providers) and may experience interruptions. We will provide reasonable notice of planned maintenance.
11. Billing and Payment
Paid plans are billed monthly through our payment processor. Each plan includes a monthly action quota; current prices, quotas, and overage rates are published on the pricing page.
Builder trial and auto-conversion
The 14-day Builder trial is opt-in and requires a card at signup. When the trial ends, it automatically converts to a paid Builder subscription and the card on file is charged $29/month unless you cancel before the trial ends. You can cancel at any time from the dashboard billing page; if you cancel during the trial, you keep trial access until it ends, you are not charged, and your account then moves to the Free plan. We send a reminder email before the trial converts. Overage is not available during the trial — the trial is hard-capped at its included actions.
Metered overage and spend caps
Builder and Pro plans allow overage beyond the monthly action quota, metered per action and billed at the published overage rate with your monthly invoice. To keep overage bounded, every paid plan starts with a default monthly spend cap (published on the pricing page). You can raise or lower the cap from the dashboard, but it cannot be removed; requests beyond your cap are rejected rather than billed.
Failed payments
If a payment fails, our payment processor retries the charge automatically and we notify you by email. If the invoice remains unpaid 7 days after the first failure, your account is suspended to the Free plan until payment succeeds. You keep dashboard access and your data either way.
Cancellation
You may cancel a paid subscription at any time from the dashboard billing page; cancellation takes effect at the end of the current billing period, after which your account moves to the Free plan.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBUPLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the dashboard. Continued use of the Service after changes constitutes acceptance.
